The law that applies in Poland recognizes that rape occurs when there is violence, and justice can only be sought by the person who expressed loud and clear opposition in that situation. This definition excludes, among other things, rapes in situations where lack of consent was not expressed due to fear or a "duty" in formal relationships where asking for consent may seem unnecessary.
